  1. Dear Secretary De Lima,

    I would like to draw your attention to the case of Gaily Miraato. Around 10pm on the evening of August 8 2012 Gaily Miraato, a 6-year old girl was hit by a stray bullet allegedly coming from 65th IB, PA camp at Agus 1, Brgy. Datu Saber, Marawi City. The victim sustained one gunshot wound in her back tht exited through her chest resulting in her instant death.

    The incident was reported to the Philippines National Police on August 11 (Police Blotter dated August 12 2012, entry No. 1208-85 Date: August 11 2012 11:45am) in Marawi City and to the Regional Human Rights Commission. The case now rests with the MOLEO (Complaint reference: OMB-P-C-13-0022) who have, as yet, not issued a resolution. The Regional Human Rights Commission who carried out an initial investigation in 2012 has still to issue a resolution. The case was also investigated by the International Monitoring Team, Human Rights Expert in 2012 and information on the case was transmitted to the Peace Panels in October 2012.

    I am sure you share in the frustration of the family that nearly three years after the death of Gaily Miraato justice has still not been served. As a State Party to the International Covenant on Civil and Political Rights (1966) the Philippines is obliged under Part II Article 3 Paragraph a) To ensure that any person whose rights or freedoms are violated shall have effective remedy notwithstanding that the violation has been committed by persons acting in an official capacity, and Paragraph b) To ensure that any person claiming such a remedy shall have his (sic) right thereto determinned by competent judicial, administrative or legislative authorities, or by any other competent authority provided for by the legal system of the State, and to develop the possibilities of judicial remedy.
